Entering this contest is free and you are not required to pay any fee. Your participation entails that you fully agree to abide by the following rules and its execution by us.
A)Participation :
Any individual residing in the Eurozone may enter the contest, except any employee of the organizing corporation, any employee of its subcontractor or any family member of these employees sharing the same address.
A minor can enter the contest provided that he has the agreement of his parent or legal guardian.
B)Prizes :
The winning prizes are displayed on the home page:
The winners will take the prize as is. No date or prize modification for any reason whatsoever may be requested by the winners. No claim of substitution or cash alternative may be requested by the winners.
The organizer does not provide any warranty or support service, only the aforementioned prizes will be awarded.
The organizer will send the prizes to the winners by regular mail. The organizer cannot be held responsible for any loss and partial or complete destruction of the prize because of the services of La Poste and / or any other issue resulting from a failure from La Poste or any other carrier.
C)Rules :
The rules are lodged with Maitre Dufour, Habitation Bois Carré, 97232 Le Lamentin, MARTINIQUE.
A copy of the rules may be sent by email to anyone. The request to receive the rules shall be written to Air Sensation, 34 rue Victor Hugo, 69490 Pontcharra sur Turdine.
The cost of the Internet connection in order to enter the contest may be refunded. The refund is limited to one connection by entrant, and shall be requested at the latest seven (7) days after entering the contest (as proved by the postmark), at the aforementioned address. The stamp will be refunded at the current second class rate, according to the aforementioned conditions.
The following information are mandatory for any refund request :
• the name of the contest ;
• date and time of connection ;
• Bank account details
• a copy of the subscription contract with the telecom provider through which the messages has been sent ;
• a copy of the detailed invoice of the telecom provider through which the messages has been sent.
Any missing information will result on immediate dismissal of the request without further consideration..
D)Contest modification :
The organizer may modify, extend, shorten, suspend or cancel the contest for any reason whatsoever without prior notice. In such case, no liability may be held against the organizer and the prizes and their values may be changed proportionaly to the new duration of the contest. No compensation whatsoever may be requested by the participants.
The organizer may replace the prizes by prizes of similar or superior values if it happens that the original prizes were unavailable. No objection related to the replacement may be expressed.
In case of circumstances beyond their control however, if the aforementioned prizes cannot be provided by the organizer, no claim of substitution or cash alternative may be requested.
The winners acknowledge and agree that their name and address may be used freely on Bet-and-Fly.com and in any promotional events or advertisements related to this contest. In accordance with the French Data Processing and Freedom Act ("Loi Informatique et Libertés") n°78-17 of the January 6th, 1978, any participant has the right to access, edit or delete any of their personal data, and may rebut any computer processing of these data by written request to: Air Sensation, 34 rue Hector Berlioz ; 69490 Pontcharra sur Turdine.
E)Limitations of Liability
The organizer does not control the operations and restrictions of the Internet and cannot be held liable for any issue resulting from the use of this network. The organizer cannot also be held liable to any issue pertaining to the loss or any delivery problem of any postal or electronic mail.
The organizer specifically may neither be held responsible for any material or immaterial damage to the participants, their computer hardware and software, and the data stored within, nor for any effects on their personal, professional activity or business.
The organizer may not be held liable if one or many participants cannot enter the contest as a result of a technical failure or any problem pertaining to, and without exclusive:
• network congestion ;
• human or electric error ;
• any malevolent intent or action ;
• the phone line ;
• hardware and software ;
• any software or hardware failure ;
• Force majeure (Act of God, vis major) ;
• Disturbances that may impede the contest.
F)Breach of rules:
The organizer may cancel the contest entirely or partially in case of breach, cheating, deception or fraud in any form whatsoever, particularly a computer-driven fraud, occuring in the participation in the contest or the selection of the winner.
In such case, the organizer may decide not to award the prizes to the cheater and/or subject them to legal proceedings before the relevant courts.
G)Statement
The sole participation in this contests entails that the participant formally agrees to these rules, and to the arbitration of the organizer in any foreseen and unforeseen situation.
The organizer and the contest participants agree to try to reach an amicable resolution in any dispute occuring within the contest rules. However, if the two parties cannot reach such an agreement, and except instructed otherwise by the law, the courts of Lyon have an exclusive jurisdiction over any dispute.
